DCR 3.125 Pleadings Using Generative Artificial Intelligence (AI)

If any portion of a pleading or other paper filed with the Court has been drafted utilizing generative artificial intelligence (Al) including, but not limited to, ChatGPT, Harvey.Al , or Google Bard, all attorneys and pro se litigants filing such pleadings or other papers must do the following: 1) verify that any language, materials or content that was generated was checked for accuracy, using print reporters, traditional legal databases, or other reliable means; and 2) disclose to the Court and opposing parties at the time of filing, in writing and clearly marked on the first page of the document, that it contains Al generated language, materials or content, along with a certification that it was checked for accuracy as required by this rule. Al systems may not be factually or legally trustworthy sources of information without human verification. Violation of this rule may subject attorneys and prose litigants to sanctions.
