COMES NOW the plaintiff, by and through its attorney, John N. Smith, Jr., and for its cause of action against the above-named defendant, alleges and states:

3. That, on or about May 12, 2000, the defendant gave or caused to be given to KWIK SHOP, Payee herein and a contractual client of the plaintiff, a worthless check, as defined by K.S.A 60-2610, in the amount of $7.34. Plaintiff is a agent of the lawful holder of said check.
4. That, acting in full good faith, Payee deposited the check in its business account. The check was dishonored by the payor bank and returned to payee, "INSUFFICIENT FUNDS".
5. That, as agent of Payee, and in full accordance with an agency agreement between the plaintiff and this merchant, plaintiff mailed a letter, via certified mail, to the defendant June 30, 2000, requesting payment and providing defendant with notice as required by K.S.A 60-2610.
6. That, pursuant to K.S.A. 60-2610, the 14-day time period has passed and defendant has failed to tender payment for the amount lawfully demanded.
7. That, it is specifically alleged that the holder of these worthless checks had conspicuously posted in its place of business, in full accord with the provisions of K.S.A. 60-2610 (g)(3), a notice that the service charge for a returned check is $30.00.
Further, that, the plaintiff specifically alleges that the attorney fee of $270.00 prayed for herein is reasonable, in accord with K.S.A. 60-2610 & -2611, and that neither the worthless check holder nor the plaintiff herein will be adequately compensated unless the reasonable attorney fee is awarded in addition to damages and other amounts prayed for pursuant to K.S.A. 60-2610 and 60-2611.
WHEREFORE, plaintiff prays for judgment against the defendant for:
$7.34 in actual damages, $30.00 for a service fee, $5.73 for certified mail costs; not less than $300.00 for Costs of collection including but not limited to reasonable attorney fees ($270.00 attorney fees and $30.00 special process server fee) and, $100.00 for statutory damages, for a total demand for judgment in the amount of $443.07, less any payment received, plus pre- and post-judgment interest at the statutory rate and costs of $26.00, and for such other and further relief and the court deems just and equitable.
