and arguments of counsel, the Court pronounces the following
sentence: The Court finds the defendant's criminal history
classification is I. Criminal History as shown in the P.S.I.
is uncontroverted. Allocution offered to the defendant.
Sentenced to custody of Sec. of Corrections as follows: Ct 1
a term of 59 months. Post release supervision period is 36
months. Defendant shall receive credit for time served as
provided by law. Departure factors: COURT DEPARTS
DISPOSITIONALLY FROM PRESUMPTIVE PRISON TO PROBATION, FOR
THE FOLLOWING SUBSTANTIAL AND COMPELLING REASON, PURSUANT TO
K.S.A 21-47 16 (c) (1}: 1. VICTIM WAS AN ACTIVE PARTICIPANT
IN THE CRIME. 2. DEFEND ANT HAD A PASSIVE ROLE. 3. DEFENDANT
SUFFERED FROM MENTAL IMPAIRMENT. 4. THE DEGREE OF HARM LESS
THAN TYPICAL FOR THIS OFFENSE. 5. SUPPORTIVE FAMILY OF THE
DEFENDANT. 6. DEFENDANT INITIATED TREATMENT AND REHABILITA
ION. 7. REHABILITATION NO PRISON IS IN THE BEST INTERESTS OF
THE DEFENDA NT AND THE COMMUNITY. The court suspends
execution of sentence of imprisonment places defendant on 36
months supervised probation. Supervision by Community
Corrections/ISP with the following conditions: a) You shall
pay: Ct Costs $ 163.00, Probation $ 50.00, b) All supervised
probation is subject to the District Courts Standard
Conditions of Probation set forth in DCR 3.308 which the
Court directs be incorporated into your order of probation,
a copy will be provided to you by Court Services. c) Other
Special Conditions: 1. Abide by ISP contract, incl.
surveillance program. 2. You shall submit to mental health
evaluation and follow all recommendations. 3. Community
service work 40 hours and execute waiver of liability. 4.
This defendant should be advised of the prohibition against
carrying a firearm pursuant to K.S.A. 21-4204. Defendant
advised of right to appeal conviction and sentence forma
pauperis. MAINTAIN INDIVIDUAL PSYCHOTHERAPY WITH PERIODIC
FAMILY MEETINGS WITH DR. RODEHEFFER UNTIL DR. RODEHEFFER
FEELS HE IS STABLE FROM DEPRESSIONS, HAS HIS ANXIETY UNDER
CONTROL BAR PROCESSED, THE EMOTIONAL TRAUMA BE HE
EXPERIENCED IN VIRGINIA, HAS PROCESSED THE CAUSE OF HIS
OFFENSE; POSSESSES INTERNAL SAFEGUARDS AGAINST RE-OFFENSE
AND DEMONSTRATED REALISTIC CONSISTENT PRODUCTIVE EMOTIONAL
STABILITY. DEFENDANT TO SIGN ANY NECESSARY RELEASES FOR THE
PURPOSE OF ALLOWING ISP TO OBTAIN QUARTER LY AND/OR SEMI
ANNUAL REPORTS FROM DR. RODEHEFFER OR AS OFTEN AS ISP DEEMS
NECESSAY. IN CLOSE CONJUNTION WITH PSYCHOTHERAPY THE
DEFENDANT SHOULD CONTINUE ON PRESCRIBED MEDICATIONS FOR
EMOTIONAL STABILITY. RELEASES SHOULD BE PROVIDED TO THE
PHARMACOTHERAPIST AND PYSCHOTHERAPIST SO THEY CAN
COMMUNICATE AND CONFER REGARDING DEFENDANT'S PROGRESS. ISP
CAN MAKE REGULAR UNQUIRIES INTO HIS PROGRESS. DEFENDANT
SHOULD EXPECT A THREE TO FIVE YEAR TREATMENT ACCORDING TO
DR. PETERSON. COMPUTER USE SHOULD BE MONITORED AND
RESTRICTED. DEFENDANT SHALL NOT BE PERMITTED TO USE A
COMPUTER FOR ANY ILLEGAL, PORNOGRAPHIC OR EXPLICITE SEXUAL
DISPLAY S OR USE. DEFENDANT SHALL SUBMIT TO PERIOD UA
SCREENS FOR ILLICIT DRUGS AS PROVIDED UNDER DCR 3.308 AND IN
KEEPING WITH ISP POLICY. ISP SHOULD RESERVE ANY OUTPATIENT
SEX OFFENDER TREATMENT WITH DCCA OR SETH WESCOTT, MS SO LONG
AS SATISFACTORY PROGRESS IS BEING MADE WITH DR. RODEHEFFER.
IF FOR ANY REASON PROGRESS IS NOT SATISFACTORY, DCCA
TREATMENT MAY THEN BE CONSIDERED. THIS IS PART OF DR.
STEPHEN PETERSONS PSYCHOTHERAPIST'S RECOMMENDATION OF
PROBATION. IF DR. RODEHEFFER IS FOR SOME REASON NOT
AVAILABLE, THE DEFENDANT SHOULD FIRST BE TRANSFERRED TO
