(a) Pre-sentence investigations for both felony and misdemeanor DUI cases shall be prepared by Sunflower A.S.A.P. If there is a felony conviction(s) in addition to the DUI, Court Services also must prepare a pre-sentence investigation that includes a criminal history classification.
(b) Supervision of misdemeanor DUI’s will be assigned to Sunflower (A.S.A.P.) and supervision of felony DUI’s or felony cases with misdemeanor DUI charges will be assigned to Court Services or ISP unless the DUI is a 4th or subsequent DUI in which case the supervision is assigned to the Department of Corrections for post release supervision.
(c) Pursuant to K.S.A. 8-1567(i)court costs and other fees shall be required to be paid within 90 days.
